Please read these Terms and Conditions carefully. By using our calculators, pages, or participating in the Referral Partner Program, you agree to comply with and be bound by these rules.

1. Agreement to Terms

These Terms and Conditions constitute a binding legal agreement between you ("User", "Agent") and BondShare ("we", "us", or "our"). Accessing or using any page, calculator, pre-qualification upload widget, or modal under the BondShare banner indicates full acceptance of these terms.

2. Intermediary Service Role

BondShare operates exclusively as a home loan intermediary service. We assist property buyers in obtaining finance approvals from participating South African retail banks and negotiate interest rates. We are not a credit provider, bank, or underwriter. Financial approvals are subject entirely to the credit policies and assessments of the lending banks.

3. Commission Referral Partner Rules

Independent real estate agents who register for the Referral Partner Program agree to the following payout structures and compliance checks:

**Referral Commission:** Participating partners are eligible for a +0.25% commission rate boost on referred home loans, capped at a maximum rate of 0.70%.
**Compliance Verification:** Referral commissions will only be paid out to registered agents who hold a valid **Fidelity Fund Certificate (FFC)** issued by the Property Practitioners Regulatory Authority (PPRA) of South Africa.
**Payment Terms:** Referral commission payouts are processed and dispatched strictly upon successful transfer and registration of the property at the Deeds Office.

4. R200 Beat-Your-Rate Guarantee Guidelines

We pride ourselves on securing the best commission rates for our partners. To claim our R200 value guarantee, you must satisfy the following criteria:

You must provide official written proof of a higher valid commission quote or structure issued by a registered competing bond originator for the same referred transfer.
The competing offer must be active and verifiable by our auditing team.
If we cannot equal or exceed that competing structure, we will pay you R200 cash as a guarantee of our competitive commitment.

5. Document Integrity Requirements

When uploading client pre-qualification files via our dashboard, the submitting agent represents and warrants that:

They have obtained the explicit, written consent of the buyer to collect and submit their personal and financial records for home loan qualification purposes.
To the best of their knowledge, all uploaded document copies (ID, payslips, bank statements) are genuine, unaltered, and correct.
They will not submit files that exceed our **20MB size limit** per file slot.

6. Limitations of Liability

To the fullest extent permitted by law, BondShare, its directors, employees, or tech partners shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from:

The rejection of any home loan application by participating banks.
Technical downtime, network lag, or failures of GHL webhook transfers.
Incorrect or outdated financial calculations generated on our calculator tools.

7. Governing Law

These Terms and Conditions shall be governed by, and construed in accordance with, the laws of the Republic of South Africa. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the South African courts.
